Terms of Use
In short: Use ViralPix for fun, lawfully, with your own photos or photos of people who have given you permission. Pro is billed through Apple, renews automatically and can be cancelled anytime in your App Store settings.
1. Acceptance of these Terms
These Terms of Use ("Terms") govern your use of the ViralPix mobile app (the "App") provided by ViralPix Team ("we", "us"). By downloading or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
2. The service
ViralPix uses AI to create a new image from a photo you choose, based on the template you select. Images are generated using a third-party AI service (Google Gemini). We do not guarantee that the service will be uninterrupted or error-free; temporary outages may occur due to maintenance, updates or issues with third-party services.
3. Who can use ViralPix
You must be at least 13 years old to use the App. If you are under 18, you may use the App and its purchase features only with the permission of a parent or legal guardian.
4. Photos you upload
- Only use your own photos or photos for which you have permission from everyone shown.
- You confirm that you have the right to use the photos you upload and that doing so does not violate anyone's rights, including personality, copyright and privacy rights.
- You keep all rights to your photo. You give us permission only to process your photo and pass it to our service provider to create the image. We do not store your photo on our server.
5. Prohibited uses
You may not use the App to:
- Use other people's photos without their permission, or impersonate, deceive or humiliate anyone;
- Attempt to create any sexual, obscene or exploitative content involving minors;
- Create images containing nudity, sexual content, violence, hate speech, harassment or discrimination;
- Create misleading, fake ("deepfake") or defamatory content about real people and present it as real;
- Create fake identity documents, official papers or images intended for fraud;
- Violate applicable law or anyone's intellectual property rights;
- Abuse the App or our servers through reverse engineering, automated access, attempts to bypass limits or fraudulent purchases.
The AI service may refuse some requests because of its safety filters. If we detect use that violates these Terms, we may restrict your access to the service.
6. AI-generated images
- Images are generated automatically by AI. We do not guarantee that results will meet your expectations, look exactly like you or be free of errors.
- You may use the images you create personally and share them on social media. We do not claim ownership of them. However, the intellectual property status of AI outputs may differ from country to country, and you are responsible for how you use the images.
- Images contain an invisible SynthID watermark indicating they were created with AI. You should not present them as not being AI-generated.
7. Free use and limits
With free use you can create a limited number of images per day (currently 2). Pro applies a daily fair-use cap (currently 10 per day). Credits refresh daily and unused credits do not carry over. We may change limits and templates to keep the service sustainable; current limits are shown in the App.
8. Pro subscription
- ViralPix Pro is an auto-renewing subscription offered weekly, monthly and yearly. Current prices for your country are shown in the App.
- Payment is charged to your Apple ID account at confirmation of purchase.
- The subscription renews automatically unless cancelled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the end of the current period.
- You can manage and cancel your subscription on your iPhone under Settings → your name → Subscriptions. Cancellation takes effect at the end of the current period.
- Because payments are processed by Apple, refund requests are subject to Apple's policies and can be made at reportaproblem.apple.com.
- If a free trial is offered, any unused portion of it is forfeited when you purchase a subscription.
- Price changes are notified in advance in line with Apple's rules.
9. Intellectual property
The App and all its content, including its design, templates, template instructions, logos and the "ViralPix" name, belong to us or our licensors. We grant you a limited, non-transferable, non-exclusive license to use the App for personal, non-commercial purposes in accordance with these Terms.
10. Changes to the service and termination
We may change, suspend or discontinue the service, templates and features at any time. If we discontinue the service entirely, we will give reasonable advance notice. We may limit your access if you violate these Terms. You can stop using the App at any time by deleting it; you must cancel your subscription separately through Apple.
11. Disclaimer and limitation of liability
The App is provided "as is" and "as available". To the fullest extent permitted by law, we make no express or implied warranties regarding the App's fitness for a particular purpose, availability or freedom from errors. To the extent permitted by law, we are not liable for indirect damages, loss of data, loss of profits, or damages arising from the use of generated images by you or third parties. Our total liability is limited to the amount you paid for the App in the 12 months before the claim. These provisions do not affect any rights you have under consumer protection laws that cannot be limited by contract.
12. Apple-specific terms
These Terms are between you and us, not with Apple. We, not Apple, are solely responsible for the App and its content. Apple has no obligation to provide maintenance or support for the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. We, not Apple, are responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, consumer protection and intellectual property infringement claims. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you. For matters not covered by these Terms, Apple's Standard License Agreement applies.
13. Governing law
These Terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Istanbul (Central) have jurisdiction over disputes. As a consumer, you retain any mandatory rights granted by the consumer protection laws of your country of residence, including the right to apply to consumer arbitration committees and consumer courts within legal limits.
14. Changes to these Terms
We may update these Terms from time to time. The current version is always published on this page, and we will announce significant changes in the App. Continuing to use the App after changes means you accept the updated Terms.
